By accessing or using the Concretex360 platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Concretex360 is a software-as-a-service (SaaS) platform that provides concrete pump management tools, including fleet management, scheduling, driver management, customer booking portals, and billing functionality. The Service is designed for concrete pump operators, rental companies, and their customers.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

  • You are responsible for safeguarding the password you use to access the Service
  • You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use
  • You are responsible for all activities that occur under your account
  • You must be at least 18 years old to use this Service

4. Subscription and Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis, depending on the plan you select.

  • Billing cycles are set on a monthly or annual basis, depending on your subscription plan
  • You agree to pay all fees associated with your subscription plan
  • Prices are subject to change upon 30 days' notice
  • Refunds are handled according to our refund policy

5. Acceptable Use

You agree not to use the Service to:

  • Transmit harmful code or malware
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Concretex360 and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Concretex360.

7. User Content

You retain ownership of any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content in connection with the Service.

You represent and warrant that you own or have the necessary rights to the content you submit, and that the content does not violate the rights of any third party.

8. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

9. Limitation of Liability

In no event shall Concretex360, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Concretex360 makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

11. Indemnification

You agree to defend, indemnify, and hold harmless Concretex360 and its licensees and licensors, and their employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time through your account settings.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in Austin, Texas.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
